Marco files appeal in boat anchoring case

The City of Marco Island has filed a formal appeal in the case to prosecute boater Dave Dumas for violating the city’s controversial anchoring ordinance.

The case was dismissed in October after Collier County Court Judge Rob Crown declared the city ordinance unconstitutional. The appeal, filed Friday, is the latest attempt by the city to defend an ordinance that limits boaters to three days of dropped anchor in city waterways without proof of a pump out.

An appeal was expected following comments by city council members and a city attorney that the city intended to appeal the decision.

A hearing date has not yet been set.
