The Clerk’s Traffic Department provides information and assistance on all Civil (non-criminal) Florida traffic violations which are payable offenses that do not carry a jail term.
They include speeding tickets, moving violations (such as running a red light and improper passing), non-moving violation (such as failure to carry your driver’s license and registration expired for less than four months) and seat belt violations.
When you receive a non-criminal traffic citation you have three options:
Option 1 - Pay the fine
By paying the Traffic Civil Penalty, you are admitting guilt and you will be assessed points on your driving record for moving violations.
The Clerk’s Office must receive your option with payment, if applicable, within 30 calendar days of the date that the officer issued the citation. Once you have chosen an option you cannot change your mind and choose another option.
Option 2 - Attend Driver Improvement School
If you choose the Basic Driver Improvement Course option, judgment is withheld, the cost may be adjusted, and points will not be added to your driving record.
The Clerk’s Office must receive your choice with the payment, if applicable, within 30 calendar days of the date that the officer issued the citation. Once you have chosen an option, you cannot change your mind and choose another option.
Option 3 - Request a court hearing
You must complete and submit a Traffic Citation Option form to the Traffic Department.
When you request a court hearing, you give up your right to pay the Civil penalty amount or to choose the driving school option.
The judge may find you not guilty in your case. However, if the judge finds you guilty, you may be fined up to $1,000 plus court costs, and in some cases, ordered to attend the Basic Driver Improvement Course as well.
